The NOTICE FILING MODULE is made available by the brokerage and distribution company "CODIF INTERNATIONAL", acting on behalf of its "PHYTOMER" Department (hereinafter "PHYTOMER"), on its website www.phytomer.co.uk (hereinafter "the Site").

The use of the "Customer Reviews" module (hereinafter the "Service") implies having a customer account and the acceptance of these terms of use. PHYTOMER reserves the right to update the terms of use of the Service at any time. In this case, the new terms of use will only apply to Notices submitted after the modification.

Each Internet user wishing to use the NOTIFICATION MODULE is invited to read these terms of use of the Service. Use of the NOTICE MODULE implies full acceptance of these terms of use.

ARTICLE 1. PURPOSE OF THE "CUSTOMER ADVICE" SERVICE

1. The REVIEW MODULE allows Users, after identifying themselves, to leave reviews, advice or information on the PHYTOMER products they have used and to give them a rating. This data will be shared with Internet users. This service is available on all product sheets on the www.phytomer.co.uk website.

2. Users publish Opinions that result from their personal experience. Each User is responsible for the content of his or her Feedback. Under no circumstances shall PHYTOMER be held liable to any person for Reviews left by a User through the REVIEW SUBMISSION MODULE.

ARTICLE 2. CONDITIONS AND LIABILITY

1. In order to submit a review, the User is required to create an account on the Site, in accordance with the Site's General Terms and Conditions of Sale.

2. The User undertakes to write a Review on a product that he has actually used. He/she attests to the truthfulness of his/her words and his/her objectivity. The publication is free of charge.

3. In order to guarantee the anonymity of the User, only the first name and the first letter of the User's surname, entered when creating his/her account, will be displayed with the Notice. The User's password and e-mail address will not be made visible on the Notice under any circumstances. The User is solely responsible for maintaining the confidentiality of his/her password and any use of his/her account.

4. The Review submitted by the User must include a title, the date of use of the product tested and a rating in the form of a number of stars, ranging from 1 to 5 stars.

5. In order to validate the publication of their opinion, users are asked to write an opinion of at least 50 characters and a maximum of 100 characters.

6. The User may also optionally enter his/her skin type and age. Personal information to help other Users in their decision to purchase the product concerned.

7. Any User of the Service acknowledges that when he/she publishes a Notice on a PHYTOMER product, his/her Notice complies with these Terms of Use and respects the legal and regulatory provisions in force.

8. In addition, the User certifies that :

• He/she is the sole author of the Notice, does not impersonate any other person and uses his/her own email address;
• Its opinion is not duplicated, that it does not infringe on the intellectual property rights of third parties;
• The content of his Opinion is accurate and objective, the result of personal experience.

9. By posting his Opinion on the Service, the User guarantees that his Opinion does not contain any content that could :

• To identify him/her; he/she will not communicate in the notice his/her full name, physical address, e-mail address, telephone number or any other information that could lead to his/her identification;
• Contain information about PHYTOMER's competitor brands or their products;
• To give information on other websites, to communicate URL addresses, e-mail addresses, postal addresses or telephone numbers;
• To have no direct link with the evaluation of the product which is the subject of the Notice;
• To give him the benefit of a counterparty from a third party in any form whatsoever;
• To be considered as an advertisement or promotional material;
• Contain a computer virus, or any other computer program or file that may damage the Service or the devices of other Users.
• Contain abusive, defamatory, threatening, abusive or vulgar, malicious, inciting to violence or hatred, and may infringe on privacy or image rights or be inappropriate in any way.

ARTICLE 3. CONTRÔLE ET MODÉRATION DES AVIS

1. Minors wishing to leave a Review on a PHYTOMER product must obtain prior authorization from a parent or legal representative. PHYTOMER may ask any minor User to provide proof of such authorization and, in the event of failure or refusal to provide proof of authorization, may refuse to publish the Review concerned.

2. All Opinions (from a User or provided by a partner Opinion Site) are subject to moderation before publication by PHYTOMER. This moderation will be carried out within 15 days from the submission of the Notice.

3. In order to facilitate the reading of the message, PHYTOMER reserves the right to correct any spelling mistakes or language errors without altering or changing the meaning of the Notice.

4. PHYTOMER may refuse to publish any Notice that it considers, at its sole discretion, does not comply with the terms of use set forth in Article 2. PHYTOMER will inform the User of the refusal of his Notice by e-mail sent to the address he will have given during his identification.

5. In addition, PHYTOMER reserves the right to refuse to publish any Notice:

• Vides/vierges ;
• Whose content is duplicated ;
• Ne contenant que des caractères aléatoires ou des suites de mots sans signification ;
• Written in a language other than English;
• Criticizing other Opinions published on the Site or the authors of those Opinions;
• Contenant des considérations d’ordre médical sur les produits ou relatifs à l’innocuité d’un produit (réactions individuelles éventuelles) ;
• Referring to problems encountered while browsing the Site, participating in a game or placing an order. These problems should be reported via our contact form and dealt with directly by Customer Services;
• Referring to exchanges with the PHYTOMER sales teams or with the network of PHYTOMER brand partner spas and institutes;

6. For any questions relating to the Company's products and their use, the User may contact PHYTOMER's Customer Service via the contact form available on the site. The Company reserves the right to communicate a User's Opinion to its Consumer Services if it deems it appropriate.

7. Once the Notice has been sent, validated and put online on the Site, the User cannot obtain the modification or deletion of the content of his Notice and PHYTOMER may publish and keep the Notice as long as it offers the Service on its Site.

ARTICLE 4. PERSONAL DATA

By participating in this NOTICE SUBMISSION MODULE you agree that PHYTOMER may use your personal data to contact you regarding your notice or for marketing purposes if you have consented.

ARTICLE 5. INTELLECTUAL PROPERTY

The User irrevocably agrees, for the entire duration of the legal period of protection of intellectual property rights, to authorize PHYTOMER, free of charge and worldwide, to use each of the notices he or she has submitted.

PHYTOMER may reproduce, represent, use, copy, modify, adapt, translate, create derivative works from, publish and distribute each Notice (in whole or in part), in the United Kingdom and throughout the world on any existing or future medium (in particular graphic and paper media, audiovisual, computer and digital communication media) for commercial, promotional or advertising purposes

The User acknowledges that PHYTOMER may translate and publish the Notice as well as the first name and the first letter of the User's name on its Facebook and Instagram pages in the United Kingdom and internationally and on any foreign version of its Site and/or on its packs distributed worldwide.

The User agrees that his Notice may be used in association with the PHYTOMER brand under the conditions set forth in the present paragraphs.
